Our Privacy Commitment

MDW, part of the Metro Pacific Water Group of Companies, is committed to our customers’ fundamental right to privacy and take great care in protecting your personal data. MDW has developed a Privacy Policy that aims to ensure all officers, employees, consultants, subcontractors, and affiliates observe the standards for personal data collection and protection in compliance with Republic Act No. 10173 or the Data Privacy Act of 2012 and its implementing rules and regulations.

Why we collect your personal information

For our valued customers and clients: MDW collects and maintains basic information about you for the following purposes:

  • New Connection / Reconnection Service Contract.  MDW collects personal information that will allow us to validate your identity and place of residence or business for purposes of billing and collection of fees for the water and other services that we will provide for you.
  • Constantly provide excellent customer service.   MDW processes the information you provide us so that we may assist you in providing safe and potable water continuously and with constant pressure.
  • Improvement of our services to serve you better.  MDW collects, uses, processes, and analyzes tomaintain a record of the services we have provided, complaints, and ratings, which will allow us to gain a better insight how we can serve you, our customers and clients, better.
  • To continuously improve our business and operations.  MDW analyzes your usage of our facilities to help us manage your account, monitor the quality of your water, train our staff, and plan for future growth and development.
  • To assist the Government.  As joint venture partnership with the Dumaguete City Water District (“DCWD”), MDW generate statistical data based on our customers’ and clients’ usage of our facilities to assist the Government in planning for future projects on creating new infrastructure, improve current facilities, minimize risk and disaster management, and other similar initiatives.  
  • To meet legal and regulatory requirements.  We perform such other processing or disclosure that may be required under pertinent laws, rules, or regulations.

Information we collect about you

  • Applying for a new connection or reconnection– complete name, home/office address, mobile phone number, landline, email address, signature, date of birth, sex, government-issued identification (including ID cards and numbers), evidence of authorization (when transacting as representative for another person),
  • When you visit our office– complete name, mobile phone number, email address, identification card, recording of image and activities inside the store as captured by our closed-circuit television cameras, health information (to comply with government-mandated screening and contact tracing for COVID-19).
  • When you visit our company website– device information (location, internet protocol address, transaction time stamp, device identification, device type, network identification, browser type, operating software type), username, password, privacy preferences and other customizable settings, settings on your contact and privacy preferences, information from cookies and tags on your devices.   • When you make service requests in person or communicate with us through different channels – complete name, mobile phone number, landline, email address, recording of your voice and conversation, billing and payment information.
  • When you comment on our social medial accounts (on Facebook, Twitter, Instagram) or share official MDW content on social media – username or social media handle, photos and videos, content of posts and comments.


How does MDW get this information?

a.  Information that you personally give us.

Most of the personal information we have are those that you have given us yourself. You provide us personal information when you:

  • Apply for our services by filling out Service Contract Application Forms, Payment Agreements and Compromises, and other similar or related documents through online, in our office, or through MDW representatives;
  • Filing a complaint or request for service;
  • Become our Vendor, Contractor or Supplier; and/or 
  • When you apply to join our team.

 b.  Information we collect while you are our customer and client 

  • Use our facilities and services ;
  • Paying your bills;
  • Use our website and social media;
  • Joining our promos, prize raffles, or contests

Disclosure of personal information

There are situations where we may need to disclose or share some of the information that you have provided to us.  We ensure that your personal information is disclosed following applicable rules and regulations of the Data Privacy Act. We will never share or sell your personal information to third parties outside of MDW except where you may have given your written consent to us to do so.

In limited circumstances, we may be required to disclose your personal information to our staff, subcontractors, partners and other third-party agencies as part of our legitimate and regular business operations.  This means we might share your information with;

  • Business partners that act as our service providers, contractors, professional advisers who help us provide our services to you;
  • Metro Pacific Water Companies, Subsidiaries, and Affiliates;
  • Subject to applicable laws and regulations, law enforcement and government agencies; and
  • Other companies whom you have also given consent to share your information.

Protection of your personal information

We strictly enforce our Privacy Policy within MDW and have implemented technical, organizational and physical security measures to prevent destruction, unauthorized access, alteration, disclosure, fraudulent misuse and/or any other unlawful processing.  MDW requires all of our vendors and processors to implement the same security measures.

 How do we protect your personal information:

  • A secured server behind a firewall, encryption and security controls.
  • Keeping your information only for as long as necessary for the fulfillment of the purposes for which the information was obtained or for the business, legal claims and purposes, or for legitimate business purposes, or as provided by law.
  • Digital and physical restriction of access to your information to authorized personnel with strict confidentiality.
  • Notification to you and the National Privacy Commission when sensitive or personal information that maybe used to enable identity fraud or are reasonably believed to have been acquired by an unauthorized person;
  • Secure update from you to keep our records accurate.

MDW will not collect, use, or disclose your personal information for any purpose other than those identified in this Commitment, your Service Agreement or our Terms of Service, and any other purpose that you may have given your consent for.

Unless you provide specific consent, we will not:

  • Share your personal information with or sell it to our business partners and third-party service providers; or
  • Use your personal information to enable third-party targeted advertisements.

Your rights as our customer and client

As our valued customer and client, you have rights in relation to your personal data under the Data Privacy Act. MDW makes sure to obtain your consent to continue to collect, use, and disclose your personal information for our legitimate business use and related purposes. As the data privacy subject, you may object or withdraw your consent and edit your information at any time to reflect correctness and accuracy.

You can request access to your personal information in our records, or if your personal information in our files is incomplete, outdated, or inaccurate, you may send a request letter or an email to the MDW Privacy Officer (DPO). 

Forms are provided according to your request, please send the accomplished form to the MDW Privacy Officer (DPO). 

Please understand that we may request for supporting documents or proof before we effect any requested changes to your personal information.

When we process your personal data with your consent, you may also have the right to object to the processing, if the circumstances warrant. We encourage you to contact MDW to seek resolution should you have any complaint. You also have the right to go directly to the National Privacy Commission or to make a claim against MDW before a competent court.

What happens when there are changes in our Policy?

In order to comply with changes in the laws, rules, and regulations, to comply with government and regulatory requirements, to adapt to new technologies and protocols, and for other legitimate purposes, MDW may, from time to time, update our privacy policy and practices

You will always be given notice if these changes are significant and, if we are required by law, we will ensure to obtain your updated consent.
